YVA Solicitors LLP – SPRING 2025 – PROMOTION (the “Promotion”)
TERMS AND CONDITIONS

1. Introduction
   1. The “promoter” of a promotion is the person who is legally responsible for operating it. The promoter of this Promotion is Property Information Company Limited (registered number 09778810) whose registered office is at Langley House, Park Road, East Finchley, London, N2 8EY (“PIC”, the “Promoter“, “our”, “us“, or “we“).
   2. “Pack” means a collection of at least 4 different products.
   3. “Search Ordering Platform” means the platform maintained by Elan Technologies Limited on behalf of Property Information Company Limited.

   5. By entering the Promotion you agree to be legally bound by these terms and conditions and warrant that you meet the eligibility criteria below. You should read these terms in their entirety but particularly your attention is drawn to Clause 5.
2. How to enter the PIC Promotion
   1. The Promotion will run from 12^th March 2025 (“Opening Date”) to 31^st May 2025 (“Closing Date”) inclusive.
   2. All search packs must be placed with the Promoter during the promotional period by no later than 17:00 on the Closing Date. All packs placed before the opening date and after the Closing Date are not included in this Promotion.
   3. To enter the Promotion entrants must place 20 Pack orders on the Search Ordering Platform, each Pack must contain at least 4 different products. A typical pack will consist of a Local Authority Search, an Environmental Search, a Chancel Search and a Drainage & Water Search. Any 4 different products can be ordered within a Pack for the same property. Partial Packs or Packs made up of searches for different properties are not included within this Promotion.
   4. We reserve the right to request sight of the original proof of purchase and proof of your identity in the form of a passport or driver’s licence and proof of address in the form of a utility bill no more than 3 months old as at the date of request.
   5. We will not accept responsibility for Packs that are unable to be placed regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
   6. We reserve the right to reject any orders that are duplicates, incomplete, incomprehensible or otherwise deficient or invalid or that we believe, in our sole opinion, arise from forgery or attempts to cheat the Promotion. We also reserve the right to reject orders that are unlawful, indecent, racist, inflammatory, and defamatory or which we consider in our absolute discretion to be otherwise harmful to our goodwill and reputation. These rights extend to removing such orders if previously accepted.
3. Where an entrant has been found to be in breach of any of these terms and conditions, we may nevertheless still enforce our right to disqualify that person even where a Gift has already been given.
4. You must enter the Promotion using your legal name.
5. Eligibility
   1. The Promotion is only open to persons resident in the United Kingdom (mainland only) who are:
      1. 18 years of age or older; and
      2. not an Excluded Entrant pursuant to clause b below,
      3. have placed 20 Packs on the PIC Searches Ordering Platform,

(an “Eligible Person”)

1. The following persons may not enter the Promotion:
   1. employees of the Promoter and members of their immediate families;
   2. any person who receives or whose business or employer receives any form of rebate, discount or contract or other support from the Promoter;

each an “Excluded Entrant”.

1. By entering the Promotion, you confirm that you are eligible to do so and eligible to claim the Gift (as defined below at clause d). The Promoter may require you to provide proof that you are eligible to enter the promotion.
2. We may in our sole discretion decide whether any eligibility requirement has or has not been met.

4. Gifts
   1. The free gift available to an Eligible Person is an Apple Watch (GPS+Cellular), Apple Airpod Pro 2 or the equivalent current model (“Gift”). Any exceptions to this are entirely at the Promoters discretion, and where a model becomes unavailable, we will get the next available equivalent model.
   2. One Eligible Person may be entitled to claim one Gift provided the entry criteria at clause 3 above are met. Gifts will be dispatched for delivery within 20 working days of Eligible Person meeting the 20 Pack order threshold in accordance with clause 2.3 above.
   3. The Gifts are subject to availability and the Promoter reserves the right to substitute the Gift with an alternative gift of equal or greater value.
   4. The Gift is non-transferable and non-exchangeable. We won’t offer or substitute a cash alternative to any Gift. You are not entitled to and may not request an alternative gift, whether cash or otherwise.
   5. Any tax payable as a result of a gift being given or received will be the responsibility of the entrant. Entrants should seek independent financial advice prior to accepting a gift if this is a concern.
   6. We make no representation or warranty in relation to gifts provided and to the fullest extent permitted by law we shall have no liability to you in relation to any gift.
   7. We accept no responsibility for any late, lost or misdirected deliveries of Gifts including, but not limited to, Gifts not received due to technical disruptions, network congestion or any other reason.
   8. No additional, further or other costs or expenses are included in any Gift unless stated in writing by the Promotor.
5. Publicity and Personal Information
   1. The personal information supplied by entrants will be used by us in accordance with our privacy policy, which you may read here: picsearches.com/privacypolicy . You must read the privacy policy as your entry in the Promotion constitutes an agreement to be bound by it. All entrants may have their details removed from our database by contacting us. Details of how to contact us are in the privacy policy referred to above. If details are removed prior to the conclusion of the Promotion and/or the delivery of the Gift, entrants will forfeit their right to claim or receive, whichever shall be appropriate, any Gift.
   2. Save where you have otherwise expressly opted out, by entering the Promotion and providing us with your details, you are consenting to receiving communications from us by post or telephone, and by email or SMS relating to the Promotion, and our products, services and other promotions that we feel may be of interest to you.
   3. It is a condition of your entry into the Promotion that we have the right to publicise, broadcast and communicate to the public the names, home towns, characters, likeness and voices of the winners for the running of the Promotion and matters incidental to the Promotion.
   4. All entrants may be required by us to participate in photo, recording, video and/or film session(s) and by entering the Promotion you agree to do so free of charge. In this regard you agree that we shall have the right to use all the resulting publicity materials in any medium (including, without limitation, the internet) and in any manner we see fit.
   5. No fees shall be payable to any entrant in relation to their entry into the Promotion and/or any subsequent publicity or promotional materials.
   6. Any and all copyright in any publicity or promotional materials in relation to or in connection with the Promotion will be owned by us.
6. Termination of the Promotion
   1. If for any reason the Promotion is not capable of running as planned as a result of any (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, we reserve the right to cancel, terminate, modify or suspend the Promotion and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem.
   2. We may vary the terms of, or terminate, the Promotion at any time in our absolute discretion without liability to any entrant or other person.
7. Our decisions are final
   1. All of our decisions relating to the Promotion and/or redemption of any Gifts are final. No discussions or correspondence with entrants or any other person will be entered into.
8. Failure to enforce terms and conditions
   1. A failure by us to enforce any one of these terms and conditions in any instance(s) will not give rise to any claim or right of action by any entrant, nor shall it be deemed to be a waiver of any of our rights in relation to the same.
9. Exclusion of liability
   1. Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded.
   2. To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any entrant in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, forfeited gifts, damages and other liabilities, provided that nothing herein shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence.
   3. In the event that any provision of these terms and conditions is held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions, which shall continue in full force and effect.
10. Governing law
    1. These terms and conditions shall be construed in accordance with and governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.
